SENEGAL – Macky Sall invited to declare his heritage

Four hundred government officials, responsible for a budget of more than one billion, must declare their assets to the National Office for Combating Fraud and Corruption (OFNAC). This is what the Tink Tank Afrijom Center under the tutelage of Alioune Tine, in its report entitled “Senegal a model of democracy in declin”, published this Wednesday, May 10, 2023.

In the document made public, the regional training and research centre raises problems about the functioning of the Ofnac. He said that 400 people had to declare their assets to the Ofnac. President Macky Sall included.

The problem of the declaration of heritage still arises because four hundred (400) personalities of the State, responsible for a budget of more than one billion, must declare their patrimony to the OFNAC,” reads the document.

According to Africajom «The President of the Republic must make a declaration of heritage before the Constitutional Council». Alioune Tine’s organization explains: «Indeed, according to Article 37 al.3 of the Constitution «The newly elected President of the Republic makes a written declaration of assets deposited to the Constitutional Council which makes it public».

In addition, the organisation adds: In addition to the Constitution, which is concerned only in a cursory manner with the President of the Republic, there is Law 2014-17 and its implementing decree, which govern in a much more complete way all other public authorities that, unlike the President of the Republic, must make their declaration before the OFNAC».

For Afrikajom, despite the fact that OFNAC is «a giant with feet of clay: endowed with the prerogatives of direct referral of the Public Prosecutor», its reports transmitted to the Public Prosecutor’s Office «have hardly experienced any palpable judicial follow-up».

Worse, after the delivery of its reports, the entity headed by the former prosecutor of the Republic, Serigne Bassirou Guèye, «is not even informed of the rankings without action of the reports filed with the Prosecutor of the Republic».

What about his independence? “Some members of the OFNAC have had their terms shortened by presidential appointment to other concurrent or even incompatible positions (appointment of the former Vice-President of the OFNAC to the Constitutional Council before the end of her term),” Afrikajom regrets.
