BENIN – Patrice Talon takes the oath Sunday, May 23

The eyes are now on the date of Sunday, May 23, for the swearing-in of candidate Patrice Talon re-elected President of the Republic after the presidential election of April 11. This is subject to the final results of this election, which will be proclaimed this week by the Constitutional Court.

The 2021 presidential process will have its epilogue with the swearing-in and investiture of the elected candidate. The latter is none other than the outgoing President of the Republic, Patrice Talon, subject to the final results of the presidential election that will be proclaimed this week by the Constitutional Court.

The swearing-in ceremony is expected on Sunday, May 23. This date is underpinned by Law No. 90-32 of 11 December 1990 on the Constitution of the Republic of Benin as revised by Law No. 2019-40 of 4 November 2019 in its article 153-3. Which article stipulates in its last paragraph that: «In all cases, the President of the Republic elected enters into office and takes the oath on the fourth Sunday of May». This fourth Sunday in May, all the lights will be on Porto-Novo, the capital city, for the ceremony to take office of Patrice Talon under his second mandate.

At the rate of 21 cannon shots, the man will take the following oath: “Before God, the masts of the ancestors, the nation and the people of Benin, the sole holder of sovereignty; We Patrice Talon, President of the Republic, elected in accordance with the laws of the Republic solemnly swear: – to respect and defend the Constitution which the people of Benin have freely given themselves; – to faithfully carry out the high functions entrusted to us by the nation; – to allow ourselves to be guided only by the general interest and respect for the rights of the human person; to devote all our strength to the search for and the promotion of the common good, peace and national unity; to preserve the integrity of the national territory; to conduct ourselves everywhere as faithful and loyal servants of the people. In the case of perjury, that we are subject to the rigours of the law.” The oath provided for in the new Article 53 of the Basic Law in force shall be received by the President of the Constitutional Court before the National Assembly, the Supreme Court and the Court of Auditors.

The Court of Auditors, which has already been set up, only remains the appointment and installation of its members. It is therefore very likely that the Court of Auditors will be operational before 23 May. The swearing-in ceremony will mark the inauguration of President Patrice Talon and Vice-President of the Republic, Mariam Chabi Talata, the duo elected by Knock-out in the first round of the presidential election on 11th April.

Until May 23, 2016, Patrice Talon, who was invested in his first five-year term on April 6, 2016, remains the President of the Republic. There is no legal vacuum in this area as some try to support it. This question of extending the mandate of the Head of State by 45 days was settled through the second paragraph of Article 157-3 of the law cited above. “The term of office of the President of the Republic in office shall end on the date of the swearing-in of the President of the Republic elected in 2021, at 00:00”. This extension of the mandate of Patrice Talon by a few days, it should be recalled, was decided by the legislator, constituting ordinary, in order to win, in 2026, the bet of the organization of the general elections, namely the presidential, legislative and municipal elections in the same electoral year.
