SENEGAL – Constitutional Council rejects opposition deputies’s appeal for annulment of Ousmane Sonko’s waiver of parliamentary immunity

The Constitutional Council rejected the opposition deputies’ appeal for the annulment of Ousmane Sonko’s waiver of parliamentary immunity. They denounce the lack of compliance with the procedure that led to the lifting of the status of deputy of their colleague, Ousmane Sonko who is accused of rape and threats by the masseuse Adji Sarr.The institution in charge of the Constitution of Senegal considered that this procedure exceeds its competence according to the laws in force.

The long-awaited response of the Constitutional Council fell this Friday, March 19, 2021. The seven wise men who make up the institution consider that the appeal of opposition members is beyond the scope of their jurisdiction. Therefore, they cannot decide to annul the waiver of the parliamentary immunity of the MP and opponent Ousmane Sonko. He was charged and placed under judicial review.

As a reminder, the opposition filed since March 3, 2021, the day before which the deputy had to respond to his summons, an appeal for annulment for violation of the procedure of the waiver of parliamentary immunity of the deputy and leader of the Pastef-les Patriotes party, Ousmane Sonko.They consider that there has been a flagrant violation and breaches of the procedure which led to the lifting of his parliamentary immunity. They had, in fact, filed an appeal for annulment with the Constitutional Council in order to hope that the whole procedure would be judged void in vain.Consultez les dictionnaires Collins et Reverso
