SENEGAL: Justice: Wade wins over Nsia Assurances

On June 4, the first civil chamber of the Dakar Extraordinary Court rejected NSIA Assurances Senegal, which wanted to validate the mortgage registered on land titles belonging to the former President of the Republic, Abdoulaye Wade and his wife Viviane Wade. The Court of Appeal of Thiès refused to validate this mortgage which, if it had prospered, would lead to a seizure followed by an auction sale of the property concerned.

As a reminder, this case is, according to the newspaper Libération, part of the violent fire that destroyed part of Lamantin Beach in 2011. After compensating the victims, the NSIA turned against Viviane Wade. The insurance company was aware that it was the guards of the Wade residence in the area who set the fire by setting fire to the dried straw.

Following a subpoena, the Court of Appeal of Thiès had sentenced Viviane Wade, whose name appeared on the house papers, to pay CFA 200 million to the NSIA. A decision upheld by the Supreme Court. On the strength of these two judgments, the NSIA had instructed a procedure to be allowed to make a conservatory mortgage of up to 200 million CFA francs on the properties mentioned above.
