SENEGAL: President Macky Sall promulgated the State of Emergency and State of Siege Act

The President of the Republic of Senegal, Macky Sall, promulgated on 19 January 2021, after its adoption in the National Assembly, the law on the state of emergency and the state of siege. The Head of State thus asks the members of the government to ensure the strict enforcement of the provisions of application of the aforementioned amended law, valid for a renewable month.

President Macky Sall promulgated Law No. 2021-18 amending Law No. 69 – 29 of 29 April 1969 on State of Emergency and State of Siege. The applicable amendment, according to a Presidency statement, enshrines the entry into force of a third legal regime that now governs the management of natural or health disasters. 

The curfew, from 9 pm to 5 am, was thus maintained over the Dakar and Thiès regions.”It is reported that we are no longer in a state of emergency. However, in the management of disasters and health crises, we are tipping over with the enactment and application, by members of the Government, governors and prefects, of security and health measures.These include curfew, regulation of rallies, meetings and the wearing of masks, as well as the organization of travel, operation of public transport and shops”, States the statement signed by the spokesperson and coordinator of the Communication of the Presidency of the Republic, Seydou Guèye.

As a reminder, on 11 January 2021, the National Assembly voted on Bill No. 46/2020 amending Law No. 69-29 of 29 April 1969 on the state of emergency and the state of siege, now extended to natural or health disasters.Thus, the title of Law No. 69-29 of 29 April 1969 on the state of emergency and the state of siege becomes “Law on the state of emergency, the state of siege and the management of natural or health disasters”.The President therefore invites people to continue individual and collective prevention efforts to stem the Covid-19 pandemic.
Since the first coronavirus case appeared on March 02, 2020, Senegal has recorded a total of 23,392 positive cases, including 19,531 cures, 536 deaths and 3,324 patients still on treatment.
